Mamphost Terms and Conditions of Service

Effective Date: 6th April, 2026

These Terms and Conditions (“Agreement”) govern the use of web hosting services provided by Mamphost (“Company”, “we”, “us”, or “our”) to its customers (“Customer”, “you”, or “your”). By using our services, you agree to the following:

 

1. Acceptance of Terms

1.1. By registering for or using any Mamphost services, you confirm that you have read, understood, and agreed to this Agreement.
1.2. This Agreement incorporates our Privacy Policy, Service Level Agreement (SLA), Acceptable Use Policy (AUP), and any other policies published on our website.

 

2. Service Description

2.1. Mamphost provides web hosting services including server space, bandwidth, email hosting and related services.
2.2. Services are provided based on the limits of your selected hosting plan.

 

3. Account Registration and Security

3.1. You must provide accurate and complete registration information.
3.2. You are responsible for maintaining the confidentiality of your login credentials and all activities under your account.
3.3. You must notify us immediately of any unauthorized use or security breach.
3.4. You must be at least 18 years old or have legal authority to enter into this Agreement.

 

4. Payment, Billing and Refund Policy

4.1 All services must be paid in advance according to the selected billing cycle.

4.2 Payment Responsibility
Payments must be received and cleared before the due date. Pending, disputed or failed payments do not prevent suspension.

4.3 Grace Period & Suspension
Accounts will be suspended 24 hours after the payment due date if payment is not received.

4.4 Termination for Non-Payment
Accounts will be permanently terminated 60 days after non-payment. All data will be permanently deleted and may not be recoverable.

4.5 Refund Policy

– We offer a 7-day money-back guarantee for first-time hosting purchases only.
– Refunds exclude domain registrations, add-ons, setup fees, and third-party services.
– Refund requests must be submitted within 7 days of purchase.
– Refunds may be denied in cases of abuse, excessive usage, or violation of this Agreement.
– Accounts suspended or terminated for violations are not eligible for refunds.

4.6 Chargebacks
Filing a chargeback or payment dispute will result in immediate suspension or termination of services. We reserve the right to recover any associated fees or losses.

 

5. Acceptable Use Policy (AUP)

You agree NOT to use our services for:

    • – Any illegal activities under applicable laws
    • – Spam, bulk unsolicited email or email abuse
    • – Hosting phishing, scam or fraudulent content
    • – Distributing malware, viruses or malicious code
    • – Unauthorized system access, hacking or probing
      – Cryptocurrency mining or abusive automation
    • – Any activity that disrupts server stability or other users

Mamphost reserves the right to suspend or terminate services immediately for violations, with or without notice.

 

6. Resource Usage

6.1. Customers must use server resources responsibly.
6.2. Excessive usage of CPU, RAM, disk I/O or processes is strictly prohibited.
6.3. Mamphost reserves the right to determine excessive usage at its sole discretion based on system performance and impact.
6.4. Violations may result in suspension, limitation or required upgrade.

 

7. Data Backup and Loss

7.1. Backups are provided as a courtesy only and are not part of the core service.
7.2. We do not guarantee backup availability, integrity, or restoration.
7.3. Customers are solely responsible for maintaining independent backups.
7.4. Mamphost shall not be liable for any data loss.

 

8. Support and Maintenance

8.1. Support is provided via ticket system and email.
8.2. We aim to respond promptly but do not guarantee resolution time.
8.3. Scheduled or emergency maintenance may occur at any time.

 

9. Service Level Agreement (SLA) – Uptime Guarantee

9.1. We guarantee 99.9% uptime per calendar month.

9.2. SLA Exclusions
The uptime guarantee does not apply to downtime caused by:

– Account suspension (including non-payment or violations)
– Customer actions or misconfigurations
– Third-party services or software failures
– Scheduled maintenance
– Force majeure events

9.3 Compensation (Service Credits)
If uptime falls below 99.9%, eligible customers may request credits:

    • – 99.0% – 99.8% → 5% credit
    • – 95.0% – 98.9% → 10% credit
    • – Below 95% → 20% credit
    •  

9.4 Credits:

Apply only to future invoices

– Must be requested within 7 days
– Are the sole and exclusive remedy for downtime
– Are capped at 100% of one month’s service fee

 

10. Limitation of Liability

10.1.  Mamphost Technologies shall not be liable for any indirect, incidental, or consequential damages.
10.2. Total liability is limited to the amount paid for the service.

 

11. Indemnification

You agree to indemnify, defend and hold harmless Mamphost Technologies, its employees and affiliates from any claims, damages, losses, liabilities and expenses (including legal fees) arising from:

    • – Your use of the services
    • – Your content
    • – Your violation of this Agreement
    • – Claims from third parties

 

12. Termination

12.1. Either party may terminate this Agreement with written notice.
12.2. Mamphost may suspend or terminate services immediately for violations, with or without prior notice.
12.3. We may, but are not obligated to, issue warnings before suspension.
12.4. Upon termination, all data will be permanently deleted without liability.

 

13. Reseller Responsibility

Resellers are fully responsible for:

    • – The activities of their end-users
    • – Ensuring their clients comply with this Agreement
    • – Any abuse originating from their accounts

 

14. Third-Party Services

Mamphost is not responsible for failures or issues caused by third-party providers, including:

    • – Domain registrars
    • – Payment processors
    • – External software or integrations

Customers are responsible for managing and renewing domain names.

 

15. Email Service Disclaimer

We do not guarantee email delivery, inbox placement or protection from blacklisting.

 

16. Force Majeure

Mamphost is not liable for delays or failures caused by events beyond our control, including but not limited to:

    • – Power outages
    • – Network failures
    • – Cyberattacks or DDoS attacks
    • – Natural disasters
    • – Government actions
    • – Upstream provider failures

 

17. Governing Law and Jurisdiction

This Agreement shall be governed by the laws of the Republic of Zambia.
All customers, regardless of location, agree to submit to the exclusive jurisdiction of Zambian courts.

 

18. Modifications

We may update these Terms at any time. Continued use of the services constitutes acceptance of the updated terms.
