Terms and Conditions of Service for Mamphost Web Hosting Company
Effective: 2nd June, 2023.
These Terms and Conditions (“Agreement”) govern the use of the web hosting services provided by Mamphost (“Company”) to its customers (“Customer”). By using our services, you agree to comply with and be bound by the following terms and conditions:
1. Acceptance of Terms:
1.1. By signing up for any of the Company’s services, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
1.2. This Agreement incorporates our Privacy Policy, Service Level Agreement (SLA), and any other policies or guidelines referenced herein or on our website.
2. Service Description:
2.1. The Company provides web hosting services, including server space, bandwidth, email services, and other related services.
2.2. The Customer’s use of the services is subject to the limitations specified in the selected hosting plan and the terms of this Agreement.
3. Account Setup:
3.1. The Customer must provide accurate and complete information during the registration process.
3.2. The Customer is responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.
3.3. The Customer must promptly notify the Company of any unauthorized use or breach of security related to their account.
4. Payment and Billing:
4.1. The Customer agrees to pay the fees specified for the selected hosting plan in advance or on the agreed-upon billing cycle.
4.2. Failure to pay fees may result in the suspension or termination of services.
4.3. All fees are non-refundable, except as explicitly stated in this Agreement or as required by applicable law.
5. Content and Usage:
5.1. The Customer is solely responsible for all content and materials uploaded, stored, or transmitted through their hosted websites.
5.2. The Customer agrees not to use the services for any illegal, harmful, or abusive activities that violate any applicable laws or regulations.
5.3. The Company reserves the right to suspend or terminate services if the Customer’s activities are found to be in violation of this Agreement.
6. Data Backup and Loss:
6.1. The Company performs regular backups of its servers but does not guarantee the availability, integrity, or completeness of any stored data.
6.2. The Customer is responsible for maintaining independent backups of their data and agrees that the Company shall not be liable for any data loss or damages.
7. Support and Maintenance:
7.1. The Company provides technical support via email or support ticket system.
7.2. While the Company endeavors to provide timely and accurate support, it does not guarantee the availability or resolution of any specific support request.
8. Limitation of Liability:
8.1. The Company shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of the use or inability to use the services.
8.2. The total liability of the Company, whether in contract, warranty, tort (including negligence), or otherwise, shall not exceed the total fees paid by the Customer for the specific services.
9. Termination:
9.1. Either party may terminate this Agreement upon written notice to the other party.
9.2. The Company may suspend or terminate services immediately and without notice if the Customer breaches this Agreement.
9.3. Upon termination, the Customer’s access to the services and all related data may be immediately removed or disabled.
10. Governing Law and Jurisdiction:
10.1. This Agreement shall be governed by and
construed in accordance with the laws of Zambia.
10.2. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Zambia.
11. Modification of Terms:
11.1. The Company reserves the right to modify or update this Agreement at any time by posting the revised version on its website.
11.2. Continued use of the services after the effective date of any modifications constitutes acceptance of the revised terms.
